When you are the victim of an accident at work, the first thing to do is to inform your employer, orally or by registered letter with the acknowledgment of receipt, which should be within 24 hours. If you are unable to do so, a third party can do it for you.
Anyway, it is essential that your employer is warned because it is for him to send the accident report to the authorities within 48 hours of the accident.
In the letter to your employer, indicate the exact circumstances of the accident and the names of any witnesses.
In Case of a Work Stoppage:
With regard to the work stoppage in question, you must be issued by a doctor in a medical certificate in 2 copies (one for you, one for the health insurance).
Your employer must give you an accident sheet (or care sheet) that will allow you not to advance your care costs.
Accident at Work or Not?
Once these steps have been taken, health insurance has 30 days to investigate the professional nature of your accident if it considers that such an investigation is necessary. If necessary, she may benefit from two additional months to complete her investigation. However, if it doesn’t decide at the end of the 30 days following the accident, it implicitly recognizes its professional nature.
In order for your work accident to be recognized and taken care of as such, it must be a sudden event (not an illness) that has resulted in at least one bodily injury and is related to your work.
Note This:
The accident at work can be settled amicably. It must be declared to the health insurance as explained above.
If your employer doesn’t complete the work-related accident report for any reason, you can do it yourself within two years of the accident. Your employer will then be liable to a fine. As for you, in case of false declaration, you incur a fine also.
If health insurance does not recognize your accident as an accident at work, it is up to you to prove your good faith.
